The Digital Services Act (EU Regulation 2022/2065) establishes a tiered content moderation framework: all services must handle illegal content reports and explain removals; online platforms must conduct risk assessments and publish transparency reports; very large platforms (>45M EU users) face systemic risk assessments and independent audits. The DSA defines obligations only for illegal content — 'harmful but legal' content is explicitly excluded from removal obligations to protect freedom of expression. Non-compliance penalties reach up to 6% of global annual turnover.

The DSA has not yet been formally incorporated into the EEA Agreement. Until incorporated by the EEA Joint Committee, it is not legally binding on EEA EFTA states (Iceland, Norway, Liechtenstein). Implementation timeline for EEA states is separate from EU member states.
